Welcome to Biluibaba. These Terms and Conditions govern your access to and use of the Biluibaba website and services. By accessing or using Biluibaba, you agree to comply with these Terms and Conditions.
1. Terms & Conditions for Users (Customers)
1.1. Account Registration
Users must provide accurate and complete information when registering for a Biluibaba account. Users are responsible for keeping their account information up to date and maintaining the security of their account credentials.
Users must not create accounts using false, misleading, or unauthorized information.
1.2. Using Biluibaba
Biluibaba provides a digital platform through which users can access pet products, veterinary services, adoption listings, and other pet-related services available on the platform.
Users agree to use Biluibaba lawfully and responsibly and must not misuse, disrupt, or attempt to gain unauthorized access to any part of the platform.
1.3. E-commerce Purchases
Biluibaba offers pet products including food, toys, accessories, grooming items, and other pet-related products.
Product descriptions, prices, availability, and other information are provided to help users make purchasing decisions. Users are responsible for reviewing their order information before completing a purchase.
1.4. Veterinary Services
Biluibaba provides access to veterinary services that may include online consultations, in-person appointments, and home services.
Veterinary services are provided by veterinary professionals registered on the Biluibaba platform. Users are responsible for providing accurate information relevant to their pet when requesting veterinary services.
1.5. Adoption
Biluibaba may provide adoption listings to help connect pets with prospective adopters and promote responsible pet ownership.
Availability of adoption opportunities may vary, and users should provide accurate information when participating in an adoption process.
1.6. Payments
All applicable payments are due at checkout unless otherwise specified by Biluibaba.
Users are responsible for ensuring that the payment information provided during checkout is accurate and that sufficient funds are available for the transaction.
1.7. Cancellation and Refunds
Cancellation and refund eligibility depends on the type of product or service involved and the applicable Biluibaba policy.
Veterinary Services:
- Veterinary service payments are refundable when an appointment is cancelled at least 24 hours before the scheduled appointment, subject to the applicable cancellation process.
Products:
- Products may be eligible for a refund within 7 days where the product is defective or damaged, subject to Biluibaba's applicable return and refund process.
1.8. User Responsibilities
Users agree to:
- Provide accurate information during registration and transactions.
- Keep their account information secure.
- Provide accurate information when requesting veterinary or other services.
- Use Biluibaba responsibly and lawfully.
- Follow applicable Biluibaba policies relating to purchases, services, cancellations, returns, and refunds.
1.9. Prohibited Activities
Users must not:
- Use Biluibaba for fraudulent or unlawful activities.
- Provide false or misleading information.
- Attempt to gain unauthorized access to Biluibaba or another user's account.
- Misuse the platform or interfere with its operation.
- Use Biluibaba in a manner that may harm other users, service providers, vendors, or the platform.
1.10. Liability
Biluibaba provides a platform connecting users with products and services. Biluibaba is not liable for indirect damages resulting from the use of the platform or services, to the extent permitted by applicable law.
Users are responsible for using the platform and its services responsibly.
1.11. Privacy and Data Protection
User information is collected, stored, and used in accordance with Biluibaba's Privacy Policy.
Biluibaba will handle user information in accordance with applicable privacy and data-protection requirements and its published Privacy Policy.
2. Terms & Conditions for Vets
2.1. Vet Registration and Verification
Veterinary professionals joining Biluibaba must provide accurate registration, professional, and identification information required for verification.
Biluibaba may verify the information and credentials provided by veterinary professionals before allowing them to provide services through the platform.
2.2. Professional Qualifications
Vets providing services through Biluibaba must possess valid professional qualifications and licenses required to practice veterinary medicine in Bangladesh, including applicable credentials from the Bangladesh Veterinary Council (BVC).
Vets are responsible for keeping their professional credentials and licenses valid and up to date.
2.3. Veterinary Services and Responsibilities
- Service Scope: Vets may provide online consultations, in-person appointments, emergency services, and home visits, subject to the services enabled for their account.
- Quality of Care: Vets are responsible for providing their services professionally, accurately, and ethically.
- Professional Standards: Vets must comply with applicable professional standards and requirements.
2.4. Pricing and Platform Facilitation Fee
- Biluibaba does not retain any commission from the vet's original service fee.
- Vets will receive their full original fees as set by them for each consultation or service.
- Biluibaba will add a fixed amount of BDT 200 to the original vet fee, which will be charged to the customer as a platform facilitation fee.
2.5. Weekly Settlement
Payments to vets will be processed and disbursed weekly. Payments from completed consultations or services during the applicable previous 7-day period will be reviewed and approved before disbursement.
2.6. Cancellation
Vets must follow Biluibaba's applicable cancellation policy and cooperate with the cancellation and refund process for eligible appointments.
2.7. Prescription and Medical Information
Vets are responsible for the accuracy and appropriateness of professional advice, prescriptions, treatment recommendations, and other medical information they provide through Biluibaba.
Users should provide accurate information about their pets to assist the vet in providing appropriate professional advice.
2.8. Confidentiality and Data Protection
Vets must maintain the confidentiality of user and pet information obtained through Biluibaba.
Vets must handle user information responsibly and maintain appropriate professional standards of privacy and confidentiality.
2.9. Liability and Indemnity
Vets are responsible for the quality, accuracy, and professional conduct of the veterinary services they provide.
Vets agree to hold Biluibaba harmless in relation to disputes arising from their professional services, to the extent permitted by applicable law.
2.10. Suspension and Termination
Biluibaba may suspend or terminate a vet account where the vet violates these Terms & Conditions, fails to maintain required professional credentials, or fails to meet applicable platform or service standards.
3. Terms & Conditions for Sellers/Shops
3.1. Seller Registration
Sellers and shops joining Biluibaba must provide accurate business, contact, and other information required for registration and verification.
Sellers are responsible for keeping their information accurate and up to date.
3.2. Product Listings
- Product Accuracy: Sellers must provide accurate and complete product descriptions, prices, availability, and other relevant information.
- Content Standards: Sellers must ensure that their listings do not contain false or misleading information.
3.3. Inventory Management
Sellers are responsible for maintaining accurate inventory information and updating product availability when stock changes.
Sellers must make reasonable efforts to ensure that products shown as available can be fulfilled after an order is placed.
3.4. Product Quality and Compliance
Sellers are responsible for the quality, authenticity, condition, and compliance of the products they list on Biluibaba.
Products must comply with applicable laws, regulations, and standards.
3.5. Commission
- Biluibaba retains a 5% commission on each product sold through the platform.
- Sellers will receive the applicable product sale amount after deduction of the Biluibaba commission and any other applicable adjustments.
3.6. Weekly Settlement
Payments to sellers will be processed and disbursed weekly. Payments from completed orders during the applicable previous 7-day period will be reviewed and approved before disbursement.
3.7. Returns and Refunds
- Sellers must comply with Biluibaba's applicable return and refund policies.
- Products that are damaged or defective may be eligible for a refund within 7 days, subject to the applicable return and refund process.
- Refund amounts relating to returns or cancellations may be deducted from the seller's future payments where applicable.
3.8. Failed Delivery
If a seller is unable to deliver a product after an order has been placed because the seller failed to maintain or update accurate inventory information, the seller will be charged a BDT 500 penalty per incident.
The applicable penalty may be deducted from the seller's future payments.
3.9. Seller Responsibilities
Sellers are responsible for:
- Maintaining accurate product information.
- Maintaining accurate inventory information.
- Providing products that meet applicable quality requirements.
- Processing orders responsibly.
- Complying with Biluibaba's applicable return and refund policies.
- Providing accurate and timely information to Biluibaba when required.
3.10. Customer Data Protection
Sellers may receive customer information necessary to fulfil orders.
Sellers must use such information only for legitimate order fulfilment and related purposes and must maintain the confidentiality and security of customer information.
3.11. Liability and Indemnity
Sellers are responsible for the products they list and sell through Biluibaba.
Sellers agree to hold Biluibaba harmless in relation to claims arising from product defects, inaccurate product information, misrepresentation, or other matters attributable to the seller, to the extent permitted by applicable law.
3.12. Suspension and Termination
Biluibaba may suspend or terminate a seller account where the seller violates these Terms & Conditions, repeatedly fails to meet applicable product or service standards, provides misleading information, or otherwise fails to comply with Biluibaba's policies.
4. General Provisions
4.1. Intellectual Property
Unless otherwise stated, Biluibaba and/or its licensors own the intellectual property rights relating to the material available on Biluibaba. All applicable intellectual property rights are reserved.
Users may access material from Biluibaba for their personal use, subject to these Terms & Conditions and applicable restrictions.
4.2. Account Suspension and Termination
Biluibaba reserves the right to suspend or terminate accounts where users, vets, or sellers violate these Terms & Conditions or fail to meet applicable platform, service, or quality standards.
Biluibaba may suspend or terminate access to the platform where reasonably necessary to protect the platform, its users, service providers, vendors, or business operations, subject to applicable law.
4.3. Amendments
Biluibaba reserves the right to update or modify these Terms & Conditions from time to time.
Where material changes are made, Biluibaba may provide appropriate notice through the platform or other available communication channels.
Continued use of Biluibaba after the effective date of updated Terms & Conditions constitutes acceptance of the updated terms, where applicable.
4.4. Applicable Policies
These Terms & Conditions should be read together with Biluibaba's other applicable policies, including its Privacy Policy and Return & Refund Policy.
Where a specific policy applies to a particular transaction or service, that policy will apply to the relevant transaction or service in addition to these Terms & Conditions.
